Terms of Service

1. Acceptance of Terms

By accessing or using ADHD Habit Tracker (the "Service"), operated by Perez Media Agency ("we", "us", "Seller"), Zentnerstraße 6, 80798 Munich, Germany, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are at least 16 years old, or have parental consent.

2. The Service

ADHD Habit Tracker is a digital wellness tool that helps adults and families build daily habits using streak shields, energy check-ins, a dopamine reward menu, a focus pet, a focus timer, a win journal, and an optional parent dashboard. It is not a medical device and is not a substitute for professional medical or psychological advice.

3. Account & Authority

You are responsible for keeping your account credentials secret and for activity under your account. If you create an account for an organisation or a child, you confirm you have the authority to do so.

4. Acceptable Use

• No unlawful use, fraud, or spam.
• No intellectual property infringement or circumvention of technical limits.
• No security interference (malware, scraping, probing, automated abuse).
• No reverse engineering or unauthorised resale of the Service.

5. Plans and Payment

The Service offers a Free plan and paid Pro / Family subscriptions (currently €4.99 / €9.99 per month, or yearly equivalents). Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions auto-renew until cancelled. You can cancel at any time; access continues until the end of the current billing period.

6. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Intellectual Property

The Service, including all software, content, branding, and design, is owned by Perez Media Agency or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service within your active plan.

9. User content

You retain ownership of habits, journal entries, and other content you create. You grant us a limited licence to host and process that content solely to operate the Service.

10. Suspension & Termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated/serious policy violations. On termination, you may export your data for 30 days before deletion.

11. Warranties & Service level

To the maximum extent permitted by law, the Service is provided "as is" without warranties. We do not guarantee uninterrupted or error-free operation.

12. Limitation of Liability

To the extent permitted by law, our aggregate liability is limited to fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages. Nothing excludes liability for fraud, death, or personal injury where prohibited by law.

13. Indemnity

You will indemnify us against claims arising from your content, unlawful use, or violation of these Terms.

14. Changes

We may update these Terms. Material changes will be announced in-app or by email. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Exclusive place of jurisdiction is Munich, to the extent permitted by law.
